Challenge to change dependet B permit into independent permit

Hi Everyone,

As always I am hoping to get some advice from this forum.

Here is my story: I moved to Switzerland in 2011 to do my Masters thesis, I was given an L permit for 6 months. After graduation I got married to my fiance who was already leaving and working in Switzerland. I got an offer to my current job (permanent position) in April 2012 and has been working for the same company since then. There was no complication to start the job even though I am from third country since my permit allows me to work with out any additional requirements.

Now my Husband job contract as well as our permit will expire in few months. So I called immigration office and asked if I can apply for an independent permit since I have indefinite work contact. They told me to contact Arbeitsamt. The information I got was the company has to apply for a work permit on behalf of me and it should not be complicated since i am well qualified and have several years of experience in the field.

So I went to HR and explained my case, HR was willing to start the process immediately and start collecting information. SO they called Arbeitsamt and was told regardless of how long I worked for the company, the company has to put the position on market and try to find a replacement from Switzerland or EU countries. Unless they prove they cannot find someone who could do my job from Switzerland or EU countries I will be considered as a new job applicant from third country.

So I am having a little headache, did someone has similar experience which can be shared please. Will there be any workaround to get the permit without so much hassle. Do the company has to put the position open ? Should I have to contact lawyer?
